Stop Smart Meters! is not taking a position regarding the guilt or innocence of the accused. However, we are pointing out that obtaining private smart meter records without a warrant is being carried out by law enforcement routinely now in many areas, and the public remains largely unaware of this fact. This case is an important piece of evidence that this is in fact occurring, contrary to the claims of the City of Naperville (CON) in their 4th amendment suit. We have a legal precept in the US called innocent until proven guilty. James Bates, as with any other accused, deserves a fair trial. And if the prosecution is using the smart meter data to reach a conclusion about Mr. Bates’ activities on the night in question, then an analysis of the accuracy of such data is very relevant for the defense to bring up and get to the truth.

It’s not like this man just drowned in his friends hot and the police looked at the water service records and decided solely off of that, that he was murder. If you were to actually read about this case (anyone who is curious to hear the whole story) you would find that much of this is only a small part of the story. In fact the coroner ruled the man’s cause of death to be strangulation aided by drowning. Plus the victims face was beat up and bleeding, which obviously doesn’t happen if one simply drowns. Be against smart meters if you want, but the simple truth is in this case it helped bring a murderer to justice and give a man’s family some answers they deserve. It’s disgusting to make this about anything other than what it is, a murder case!

The last guest McDonald, was already home by 12:30 according to the police report. At the time the water was used it was just the 2 of them.

IF the man was murdered, the ‘other’ guest who was left in the tub might have committed the murder and used the water.
