Peevey Farewell Love Fest Disrupted by Smart Meter Protests

The December 18th 2014 meeting of the CPUC (a.k.a. the utility/telecommunications industry now acting as the California Public Utilities Commission) was the last for Mike Peevey- former SoCal Edison CEO and “mob boss” – a man who has driven the forced deployment of smart meters in California- and violated disability, privacy, and safety laws repeatedly to benefit his industry clients.

Outside the CPUC, on busy Van Ness Ave., mourners in black had gathered around a coffin representing victims of the smart grid, listening to eulogies to the lost and naming those responsible.  A press release had been issued and the media invited.  The press however turned their back on the funeral and were clustered instead around San Bruno mayor Jim Ruane and Senator Jerry Hill, their attention on PG&E’s other, more blatant, obvious, and sudden victims.

Inside, nauseated attendees suffered through an orchestrated Peevey-love-fest that droned on for 2 1/2 hours and quickly discovered that the public comment period was an opportunity for the corporate state to crow about how wonderful the man is––and how wonderful they are.

Their gushing praise an attempt to insulate him and thus themselves with their seedy entanglements from future prosecution for the deaths in San Bruno and deaths and injuries from hazardous smart meters.  After all, Michael Peevey, an early architect of the smart grid, is now facing investigation and possible prosecution by the US Attorney’s office and California’s Attorney General.

An entire section of public seats had been reserved for the pro-Peevey speakers and time limits were waived––as long as you had nice things to say…

This is the same crowd who flew Peevey around the world on the utility company dime in exchange for close access and influence with the top regulator.

Stop Smart Meters! Banner Drop Inside the CPUC

While Peevey’s praises were being sung, I was thinking about the many families that have an empty place at the table this Christmas because of his lax to non-existent regulatory policies.  Deaths from fire resulting from second rate equipment being installed by second rate temp workers- it all could have been prevented.  How many are suffering in what used to be a home and what is now just a place to tolerate?

The endless stream of people harmed by smart meters parading to the podium in the last 5 years will certainly cloud Peevey’s legacy.  Yet, as usual the public uprising was only lightly touched upon by the media.  In fact, as Sandi Maurer of the EMF Safety Network has pointed out, the San Jose Mercury News appears to have censored a reporter who went into some detail about the smart meter protests at the meeting, with large portions of the coverage having been removed from the original online article.

The AP ran a story that incorrectly stated there was only one person there who condemned Peevey.  In reality there were dozens.  It doesn’t make you paranoid to think that these omissions are intentional and part of a pattern.  We deserve a better press.

Representatives from state government agencies, financial beneficiaries of his policies on Wall Street, and corporate groups like EDF and NRDC crowed at the public’s podium about how compassionate to those less fortunate Peevey is, what a defender of the environment—a leader on climate change!

Returning to their reserved seats, they checked for updates on their melting-ski slope-holidays, pawing at their wireless devices as one by one, speakers went into grim detail about the misery, illness and suffering caused by exposure to wireless devices.

Members of the public (many of them injured by smart meters), were forced to sit through the hours-long, back-slapping-love-fest and thick electrosmog so that they might finally have a chance to address the commission (strictly timed of course). Yet should they speak over their allotted time, or bring up unacceptable subject matter they risked being escorted out of the room by one of the armed state police, standing by and ready to protect—should things get out of hand.

In response, we carried out a coordinated public demonstration of disgust and revulsion against Peevey’s CPUC, standing up in the meeting and holding signs naming the crimes and reading aloud the names of smart meter victims – including testimonies from thousands of California residents and those who spoke at public hearings all over the state who were ignored in the smart meter “opt out” proceeding.

Screen-shot-2014-12-22-at-12.23.22-PMWhile corporate patrons of Mr. Peevey were given up to ten minutes and allowed to wax lyrical, some smart meter and corruption critics were cut off after a few seconds- even surrounded by 3 state police when one speaker suggested that Peevey “belongs in prison” (it may not be far off- he is currently being investigated by the US Attorney and state Attorney General….)

The ones really protecting health and safety are never welcome at an agency tasked with “protecting health and safety.”

After lunch, without any debate or discussion apart from the usual platitudes, the commission approved a plan to charge every California customer of an investor owned utility who uses an analog (rather than a “smart” meter) to measure gas or electricity $75 and $10/ month ($10 and $5/ month for low income).   Those living with a bank of meters on their wall, businesses and communities as a whole would not be allowed to “opt out” at all, and even those with letters from their doctors and diagnoses of electro-hyper-sensitivity would not be permitted to retain basic utility service without paying the “opt out” charges if this decision is allowed to stand.

The commission then unanimously approved Peevey’s version of the proposed decision which added a 3 year limit to (or sunset on) individual residence opt out fees.  Questions persist about the details and rationale for this.

Today, it’s been reported that new e-mails have come to light further implicating Peevey in smart meter related corruption and collusion with PG&E to undermine local democracy.

And now today- December 23rd- Gov. Jerry Brown has announced a replacement for Mike Peevey to chair the CPUC- ex SMUD Director Michael Picker- and we do mean replacement.

Standing Up to the Sleaze and Rot that Kills

PitchforksToPGE-1One of the anti-smart meter activists I work with recently commented that the “CPUC has lost touch with reality”.  

Certainly a strong grip on reality has not been one of the CPUC’s strong suits.  A recent spot on critique from Arizona’s Warren Woodward sheds light on the intentional deception and serious departure from reality being carried out on a systematic level by state utility commissions working side by side with utility corporations.  The system of corporate power that now dominates our “regulatory” agencies has attempted to project an alternate reality that obscures harm to suit their single minded profit motive.  This system hasn’t lost touch with reality.  You can only lose something if you had it in the first place.

The CPUC’s culture has been denounced as being “sleazy” by its own employees. The head of the whole operation- at least for another few days- Mike Peevey- has been called a mob boss the way he solicits payments from utilities for favorable policies.  The CPUC’s lax to non existent regulation was directly responsible for the San Bruno pipeline explosion that killed Jacqueline Grieg (who worked for the PUC’s Division of Ratepayer Advocates to stop PG&E from gouging ratepayers) her daughter and six others.  The PUC has ignored reports from thousands of people made sick by the new meters and callously tried to stomp on the democratic rights of local governments- on this and many other issues.

People are fed up and they’re not going to take it anymore.

What to do?

If we expect that the CPUC will somehow “find reality”- in response to our good arguments- that is like waiting for a murdering psychopath to realize that killing is wrong and stop their behavior.

The PUC and the inhumane system that it represents (the “corporations masquerading as government” as Josh del Sol recently posted) will not change of its own accord no matter how many letters we send.

The attack on public health and safety and the highway robbery the smart grid represents is not the result of some “misunderstanding” or “lack of information.”

All of this is intentional and it will only stop when the criminals behind the program are forced to stop.  If a PUC commissioner suddenly woke up and realized the truth and started to actively challenge the system, the system would have them removed.  No question.  Commissioners are vetted carefully for any hint of rebellion before they are appointed.   As Emma Goldman said, “if voting changed anything, they’d make it illegal.”

Activists trying (in many cases valiantly and at great personal and financial sacrifice) have seen how fruitless it is to try and get one government agency to censure another, when the stakes are as high as a trillion dollar industry driving the global economy.

And largely a waste of our time every time we defer to their authority in any way.

What are the alternatives?  Are we doomed to submit comments to be ignored at the PUC and accept the consequences of smart grid proliferation?  Spend thousands of dollars on lawsuits just to be tossed out of court by corrupt, system-loyal judges?

Watch as our friends and families and perhaps ourselves get sick and die of cancer?  As our homes burn down at 3am and the utility blames the wiring?  As we are disconnected one by one from essential services because we refuse to agree to pay not to be harmed?

What we need is a resistance movement that protects environmental health and safety by whatever means necessary.   A group of committed individuals who will stand up against state power and refuse to back down- no matter what- in the face of injustice.  Yes we need the intelligent, well-informed critiques of current policy to spread awareness and provide fodder for those willing to take the time to analyze the truth (and lies) behind these industry documents.  But intellectual debate and discussion- or even active awareness raising campaigns- are not going to win it alone.

The smart grid is violence.  Our capitalist system is a violent system that steals from the global poor and the planet itself to make the rich richer- for a limited time only.

This horrific system- one that essentially condones police murder, torture of millions of animals and people, military-backed imperialist wars for resources, fracking, clearcutting, polluting, radiating, modifying our very genetic material.  The “Smart Grid” and its network of pulsing, deadly meters has its roots in this toxic brew of coercion and control.

These are all outcomes of a worldview that thinks of the planet and all who live on it– as dead matter to be consumed and used, profit extracted and then excreted.  Thinks of humans as being supreme beings ruling over all, but then ironically destroys the life support system that keeps us and all our relatives alive.

Unless we see the fight to “stop smart meters” in the context of this larger destructive system, we have lost before we event start fighting.  Banning smart meters would be a good thing, but leaving the system in place that brought them about is dangerous.

You can hack away at the branches but unless you get the root out evil will grow again.

Let’s remember those who died who could be alive today if money were not more important than life to this system:

Jacqueline Grieg: murdered September 9th, 2010 by gas pipeline explosion
Larry Nikkel: murdered July 9, 2010 by faulty smart meter installation
Michelle Sherman: murdered July 30, 2014 by smart meter ignited fire

How many more?  Who is next?

What do you do with a murderer on the loose?  You apprehend him and lock him up for a long time so he can’t hurt anyone else.  So why aren’t we doing this to the corporate criminals responsible for these murders?  Why do people continue to vote for politicians who are not only failing to carry out these critical prosecutions, but aiding and abetting the murderers?

Michael Peevey, the man most responsible for all this- has one meeting left to rule over and make bad jokes.  Will we just continue to file in to the CPUC like serfs, obediently sign up to speak, wait patiently in line for our turn, and beg the psychopath to change his stripes, all the while he is sitting there with a big grin, while behind the curtain lie decomposing bodies of our friends and piles of (our) cash?

Does the fact that it’s hidden make it any less of a crime?

Deceiving ourselves with the narrative that if we just get enough people to go to the mic and talk about  their illness or the confirmed science of wireless health harm or the fires that have torn families apart or the blessed privacy that’s been lost that this will all stop of its own accord?

It’s time to take it to the next level. It’s time to be honest about the need to develop a realistic plan to actually win this thing, embodying the spirit and words of Mario Savio on Dec. 2nd 1964:

“There is a time when the operation of the machine becomes so odious, makes you so sick at heart, that you can’t take part; you can’t even passively take part, and you’ve got to put your bodies upon the gears and upon  the wheels, upon the levers, upon all the apparatus, and you’ve got to make it stop. And you’ve got to indicate to the people who run it, to the people who own it, that unless you’re free, the machine will be prevented from working at all!”

If you are interested in getting serious about grinding the gears of this cruel system to a halt, and challenging the corporate power structure, it is important to realize that you are not alone.  People are waking up all over and are hungry for ways to confront injustice.   But what does this actually mean?  Can we “take back our power” with words alone?

Words can be powerful but sometimes you need action.  Direct action and civil disobedience is at the heart of the Stop Smart Meters! movement, and has been directly responsible for forcing some of the key policy changes we have seen in California and elsewhere.

I’m personally not willing to wait around for a change that will never come, or come too late to make any difference.  Running away or deferring to a psychopath’s authority is akin to suicide and I am not willing to give up my life or my health that easily (though sadly it seems many are without even a fight).

If you are reading this, then you are already aware of how serious this problem is. Maybe you have peered down the rabbit hole and understood the degree of deceit at work here.

Smart meters are safe!  Far below FCC guidelines! Go back to sleep!  Nothing to see here!

Some of you may even be brave enough to consider action that is more radical than simply making idle requests to the institutions that caused the problem in the first place.

San Antonio, TX Residents Install Analog Lockers to Defend the Elderly and Vulnerable Against CPS Smart Meters

Last month I visited the City of San Antonio, TX, interviewed local residents and confronted utility officials about their smart meter/ smart grid program. Above is a video we put together, trying to figure out what exactly it is that CPS energy “is going to do to us” and how to stop it.

During our visit we found residents up in arms, locking down their analogs, and refusing to back down.  We found the typical utility propaganda, deception, and coercion.

CPS is now threatening disconnection to disabled and elderly people 2 weeks before Christmas.  The Grinch is alive and well this holiday season, everyone.

Wherever utilities force smart meters using false and misleading information, people will resist and spread the truth, stand up and fight back.  Neighborhood organizing is critical to any successful analog meter defense.  We stand with Les Chateaux and Oliver and everyone fighting smart meters in San Antonio and all over the world.

Now is the time to fight back and demand a halt, a recall, and a ban.  Anything less will not suffice.

Give CPUC President Michael Peevey the send-off into retirement that he deserves after a dozen years of corruption and complicity with corporate utilities.

Protest the CPUC’s proposed decisions in the ‘smart’ meter opt out proceedings. Show strength in unity against their proposals that:

• Ignore serious public safety hazards including toxic injuries, fires, homelessness, violations of privacy, higher bills, loss of meter readers, and no promised energy savings.

• Continue to impose coercive extortion opt out fees

• Violate laws, and deny customer and disability rights

• Prohibit opt-outs for communities, apartment buildings, and businesses

• Reward utility companies with millions $$$ more for smart grid failings

Join us in demanding that the CPUC:

• Reject the proposed decisions-6

• Rescind and refund ‘opt out’ extortion fees

• Halt the ‘smart’ meter program

Bring any other past or present grievances against the CPUC (toxic dumping, nuclear plants, gas line explosions, accessibility, public power, etc.)

Join in demanding:

• Criminal prosecution of CPUC President Peevey and others

• Shut down the aging and hazardous Diablo Canyon Nuclear Power Plant

We will be raising our demands both outside before the meeting, as well as inside. Please come prepared to make some noise and be seen.  Wear black.   Rain or shine.

The proposed decisions would (as summarized by the EMF Safety Network):

  • Give 37 million dollars to the Investor Owned Utilities (PG&E, SCE, SDG&E, and So Cal Gas) for providing the opt-out program.
  • Adopt permanent fees for residential customers who “do not wish to have a wireless smart meter.”
  • Continue the same interim fees of $75 initial fee plus $10/month, and $10 initial fee plus $5/month for low income.
  • Local governments and multi-unit dwellings may not collectively opt out of smart meter installations.
  • Charging an opt-out fee does not violate the Americans with Disabilities Act (ADA).
  • They will not address health and safety impacts in this decision.
  • Assess fees on a per location basis, for example if you have two or more meters on your property, that will be one fee, per utility company.
  • If you have two utilities, they can both charge you fees.
  • President Peevey proposes putting a cap on the opt-out fees at 3 years.
  • Neither proposal considers a no-fee option.

Seattle Event Added to Our National Speaking Tour
